Website Hosting Service Agreement

1. Parties:
This agreement is between Mildura IT (PROVIDER) and the party as specified in the application (CLIENT).

2. Services:
This agreement covers website hosting services only.

3. Traffic Limitations:
The PROVIDER places no limit on site download or traffic.

4. Data Upload:
The PROVIDER will supply the CLIENT with a username and password to allow file uploads by FTP. The CLIENT undertakes to keep the username and password confidential.

5. Quality of Services:
The PROVIDER undertakes to take reasonable measures to ensure quality, uninterrupted services.

6. Prohibited use:
The CLIENT's web pages may not contain or link to material described as follows:
     a) pornography, sex, or anything considered to be adult content
     b) material that exploits children
     c) illegal material: illegal or hacked software, serial numbers
     d) pyramid schemes or mail fraud
     e) hate propaganda, racism, bigrotry or profanity
     f) copyrighted or protected property such as music, logos

7. SPAM:
The PROVIDER prohibits spam (the sending of bulk, unsolicited email).

8. Cancellation of Service without Refund:
The PROVIDER reserves the right to cancel services if the client is found to be in breach of the Prohibited Use or Spam clauses of this agreement.

9. PROVIDER to be Indemnified:
The CLIENT shall indemnify the PROVIDER and hold them faultless against any and all claims, losses, costs, damages or judgments arising directly or indirectly from the services provided.

10. Payment:
All hosting accounts are sold to the CLIENT on a 12 month prepaid basis.

11. Pricing:
The PROVIDER will make available online the current schedule of prices and charges for various plans.

12. Price Changes:
The PROVIDER has the right to ammend prices for services at any time by giving the CLIENT 30 days notice.

13. Late Payment:
The PROVIDER reserves the right to cancel or discontinue services should payment not be recieved within 14 days of the due date. The PROVIDER also reserves the right to levy a reconnection fee for services that have been disconnected.
